EasyPost is committed to assisting law enforcement and courts while respecting the rights and privacy of our customers and users while minimizing the disclosure of sensitive information. Once EasyPost has received and confirmed the legality and accuracy of the request for data, EasyPost will attempt to issue a timely response that complies with all laws, regulations, as well as our own data and privacy commitments, including our contractual obligations with customers.
These guidelines are provided for use by government and law enforcement agencies within the United States when seeking information from EasyPost. The information contained within these Guidelines is devised to provide information to government and law enforcement agencies within the United States regarding the legal process that EasyPost requires in order to disclose electronic information to government and law enforcement agencies within the United States. These Guidelines are not intended to provide legal advice and do not apply to requests made by government and law enforcement agencies outside the United States. Nothing within these guidelines is meant to create any enforceable rights against EasyPost, and EasyPost’s policies may be updated or changed in the future without further notice to any government or law enforcement agencies.
Customer Notice
EasyPost will notify customers when their EasyPost account information is being sought in response to a legal process from government, law enforcement, or third parties, except where providing notice is explicitly prohibited by the legal process itself, by a court order EasyPost receives (e.g., an order under 18 U.S.C. §2705(b)), by applicable law or where EasyPost, in its sole discretion, believes that providing notice creates a risk of injury or death to an identifiable individual, in situations where the case relates to child endangerment, or where notice is not applicable to the underlying facts of the case.
After 90 days, EasyPost will provide delayed notice for emergency disclosures except where notice is prohibited by court order or applicable law or where EasyPost, in its sole discretion, believes that providing notice could create a risk of injury or death to an identifiable individual or group of individuals or in situations where the case relates to child endangerment. EasyPost will provide delayed notice after expiration of the non-disclosure period specified in a court order unless EasyPost, in its sole discretion, reasonably believes that providing notice could create a risk of injury or death to an identifiable individual or group of individuals, in situations where the case relates to child endangerment, or where notice is not applicable to the underlying facts of the case.
United States Legal Process
As a company that operates under the laws of the United States, EasyPost requires law enforcement and governmental agencies to follow U.S. law when making requests for any non-public data. For all requests from government and law enforcement agencies within the United States, with the exception of emergency circumstances, EasyPost will only provide content in response to a valid subpoena, court order, search warrant or customer consent.
Non-U.S. Legal Process
All requests from government and law enforcement agencies outside of the United States, with the exception of emergency circumstances, must comply with applicable laws, including the United States Electronic Communications Privacy Act (“ECPA”). A request under a Mutual Legal Assistance Treaty must be in compliance with ECPA. EasyPost will only provide data only in response to such a legally valid process.
Retention Periods
EasyPost retains data according to our data retention schedule. EasyPost can provide EasyPost information in so far as EasyPost still possesses the requested information pursuant to its data retention policies. All other data is retained for the period necessary to fulfill the purposes outlined in our privacy policy. Data older than the specified retention period is unlikely to be available unless a formal preservation request has been received. See below for this preservation request process.
Preservation Requests
EasyPost will attempt to honor valid preservation requests under 18 U.S.C. § 2703(f). We will maintain the requested data for up to 90 days, however, this period can be extended for one additional 90-day period upon receipt of a renewed request. To request preservation, please submit a preservation request using the process below.
How to Submit Requests
EasyPost accepts service of legal processes by email to enforcement-requests@easypost.com from government and law enforcement agencies, provided it is transmitted from the official email address of the requesting agency. EasyPost does not respond to questions or any process service from private email domains. To help ensure the legal process EasyPost receives is in the form and substance that the issuing authority authorized, EasyPost requires submission of the entire legal process, including any attachments.
